Assemblymember Brown to Hold Bill Until After Court Ruling
Assemblymember Cheryl R. Brown (D-San Bernardino) has agreed to hold AB 475 in the Assembly Higher Education Committee until the Ed O’Bannon’s lawsuit is adjudicated in federal court. The case is tentatively scheduled for June 9th and will be presided over by Judge Claudia Wilken in the 9th District Court of Appeals.
“It would be preemptive to enact AB 475 before the Ed O’Bannon Case is adjudicated,” Brown said. “This case has the potential to fundamentally change the NCAA and the culture of college athletics.”
Ed O’Bannon is the lead plaintiff in a class action lawsuit against the NCAA, alleging that the NCAA violated anti-trust law by confiscating and profiting on the likeness of former student-athletes. The NCAA claims that student-athletes forfeit their right to profit from their athletic exploits when they accept a scholarship from a member university.
“I am still extremely passionate about protecting the rights of student-athletes who should receive the education they are promised when they are recruited. Once the ruling is handed down we will be ready with legislation that will empower California’s student-athletes,” Brown concluded.
