NOTICE IS HEREBY GIVEN that the City of Port Hueneme will be the Lead Agency and has prepared a Draft Environmental Impact Report (DEIR) in accordance with the California Environmental Quality Act (CEQA) for the project described below. Pursuant to Sections 15086 and 15087, Title 14, California Code of Regulations, this Notice of Availability has been issued to provide an opportunity for responsible and trustee agencies and interested parties to submit comments on the DEIR. Agencies should comment on such information as it relates to their statutory responsibilities in connection with the proposed project. Probable environmental effects of the project are described below.
Project Name: City of Port Hueneme General Plan and Housing Element Update
Project Location: City of Port Hueneme (citywide) in the County of Ventura
Some sites within the City are listed on a registry prepared pursuant to California Government Code §65962.5.
Project Description: The General Plan Update involves a comprehensive update of all elements of the existing Port Hueneme General Plan while the LCP Update involves a targeted update of that document aimed primarily at incorporating new requirements pertaining to sea level rise. All General Plan elements will be updated to reflect current conditions, requirements of Government Code Section 65302, and community preferences. Similar to the existing General Plan, the policy document containing an introduction; issue identification; goals, policies, and implementation actions; and a plan narrative describing the basis for and application of the policies. The General Plan contains the following elements: Air Quality; Circulation; Conservation, Open Space, and Environmental; Economic Development; Social Equity; Housing; Land Use; Noise; Public Safety and Facilities; Climate Action Plan (CAP) Element; and Local Coastal Program.
Public Comment Period: The DEIR will be available for public comment for a 45-day review period as specified by the State CEQA Guidelines (Section 15105). The purpose of this comment period is to consider the content of the DEIR and the potential environmental impacts that may result from project implementation, not the positive or negative attributes of the project itself. Comments pertaining to the impact analysis, criteria and thresholds, mitigation measures, and alternatives presented in the DEIR will be considered by the City during preparation of the Final Programmatic EIR (FEIR). The FEIR will include copies of comments and the City’s responses to comments pertaining to the environmental analysis provided in the DEIR. In addition, the Draft General Plan and Housing Element Update will be available for public review for 45 days concurrent with the DEIR per Government Code Section 65353. A Mitigated Negative Declaration
City of Port Hueneme
Pursuant to the State of California Public Resources Code Section 21092, this is to advise you that the City of Port Hueneme has prepared an Initial Study of environmental impacts for the following project:
Project Title: Bubbling Springs Park Renewal Project

Project Description: The Bubbling Springs Park (the Park) Renewal Project is a part of the City's effort to implement improved, expanded, beautified and safe park spaces and programming. This project will be part of the implementation of the newly adopted Parks Master Plan. This proposed project was developed through public outreach and is divided into two components; Bubbling Springs Park North and Bubbling Springs Park South. The approximately 19-acre project site is comprised of North Park and South Park. Existing uses of the North Park comprises four unlit softball/baseball fields, concessions and restroom buildings, picnic tables, parking lots, and landscaping. Existing uses of the South Park comprises the City’s Community Center, Library, parking, and passive open space currently used for informal soccer and football youth games as well as an informal offleash dog park demarcated with temporary fencing installed by an interest group. The proposed project involves upgrades and improvements to the Park, including modernization and size changes to the baseball fields; installation of stadium night lighting; expansion of the sports plaza with covered seating; building expansion for concessions; construction of a new restroom building; access and fencing improvements; replacement of all playground equipment; installation of two multiuse youth soccer/football fields with lighting, seating, fencing and amenities; installation of a dog park; landscaping improvements; and, the addition of a walking circuit with fitness stations, barbecue/picnic areas and structures. No improvements to the library, community center or associated existing facilities are proposed. The project excludes any improvements or changes to the Bubbling Springs Park Recreational Corridor adjacent to Bubbling Springs Creek.

Project Location: 550 Park Avenue in Port Hueneme, California (Assessor’s Parcel Nos. 205-037-04, 207-01-01, 207-01-09, 207-081-01, 207-09-37, and 207-09-38).

Environmental Determination: Based on the findings of the Initial Study, the City has determined that, with mitigation, this project would not result in significant environmental impacts. Mitigation measures for aesthetics (light spillover from the ball field lighting), construction emissions, potential bird nests, and cultural resources and tribal cultural resources will be required to reduce impacts to a less than significant level. Accordingly, the City intends to adopt a Mitigated Negative Declaration, pursuant to Section 21080(c) of the Public Resources Code.

The project site is not included on the list of hazardous materials facilities, hazardous waste properties, or hazardous waste disposal sites enumerated under Section 65962.5 of the California Government Code (Cortese List).

Public Review/Public Comment Period: Copies of the proposed Mitigated Negative Declaration and Initial Study are available for public review at: the City of Port Hueneme, Community Development Department, 250 N. Ventura Road, Port Hueneme, CA 93041 and online at www.ci.porthueneme.org.

At the regular meeting of July 6, 2021, the City Council of the City of Port Hueneme held a public hearing and introduced for first reading the following Ordinance:

AN ORDINANCE APPROVING AND ADOPTING A DEVELOPMENT AGREEMENT UNDER GOVERNMENT CODE SECTIONS 65864 TO 65869.5 AND ORDINANCE NO. 727 AND ORDINANCE NO. 734 OF THE PORT HUENEME MUNICIPAL CODE RELATING TO THE OPERATION OF A CANNABIS FACILITY [RED MULE GROUP, LLC]

Summary

Following a second reading on July 19, 2021 via public electronic broadcast live from the City Hall Council Chamber, located at 250 North Ventura Road, Port Hueneme, CA 93041, the City Council of the City of Port Hueneme adopted Ordinance No. 781 approving a Development Agreement which will regulate the operation of a cannabis microbusiness by the applicant, and will set forth certain rights and obligations of both parties relating thereto, including the right of the City to receive certain revenues. The Development Agreement requires that the facility be operated in accordance with all applicable laws of the State of California and all applicable ordinances of the City. The Development Agreement requires the applicant’s compliance with the Development Agreement, including payment of the City’s revenues, be reviewed on an annual basis. If the applicant is found by the City not to be in compliance with the Development Agreement, a variety of remedies are available to the City, up to and including revoking the applicant’s right to operate the cannabis facility.
