Oxnard--The City Council emerged from its Tuesday, April 16 meeting with a settlement on the Kona Kai Mobile Estates, an existing litigation.
City Attorney Stephen Fischer read the resolution and said the City Council, by unanimous vote, entered into a settlement agreement with Kona Kai Mobile Home Park Associated, doing business as Kona Kai Estates.
“Those homeowners filed a protest petition challenging the 2022-2023 rent increases,” he said. “The terms of the agreement include the park owner waives the right to collect the 4 percent rent increase that it imposed in 2022, the parties agree to a total rent increase of 5.7 percent between April 1, 2022, and March 31, 2025, and the parties agree to waive any claims regarding the current rents and any claims that they have against each other.”
Fischer said the settlement becoming effective is contingent on a number of factors, including the Mobile Home Rent Review Board approving the material terms of the agreement on or before April 26, 2024.
He said that the matter is settled if there is no successful challenge to the Board’s approval of the material terms of the agreement or a successful challenge in court.
