Oxnard--The Public Works & Transportation unanimously passed its Ordinance prohibiting single-use plastic foodware during its Tuesday, October 24 meeting.
The change preventing single-use foodware began when the City Council adopted Ordinance 3017 on July 28, 2022, restricting using single-use foodware accessories and standard condiments.
The Ordinance takes effect on January 1, 2024; however, enforcement actions under the Ordinance will not begin until January 1, 2025, to allow outreach time to the impacted businesses and organizations in conjunction with the City’s Code Compliance and environmental resources departments.
Deputy City Attorney Chelsea Balloit presented the Ordinance in response to Assembly Bill (AB) 1276, requiring cities to pass an ordinance regulating the use and distribution of single-use foodware and requiring the food facilities only to distribute single-use foodware, utensils, stirrers, splash sticks, condiment packets, and plastic straws when requested by a consumer.
“In order to comply with AB 1276, the City was required to pass an ordinance prohibiting the use of single-use foodware,” she said. “This ordinance regulated how single-use foodware accessories that are commonly made of plastic are distributed but did not ban the use.”
