Oxnard-- The story about the city council passing an amended Just Cause Eviction & Tenant Protection Ordinance and Rent Stabilization Ordinance, April 13, continues with Councilman Bert Perello saying when they talk about a five percent rent increase cap, he wanted to know what’s included in the five percent.
THE council ultimately amended the cap to four percent.
“The five percent is limited to what is defined as rent,” Housing Director Emilio Ramirez said.
“The ordinance does define the term rent,” he added. “If it is included in the rent, then it is subject to the five percent limitation.”
He noted that various landlord groups asked questions that indicated that they charge a parking fee and is the parking fee part of the rent.
“If the unit costs $1,000 and the parking fee is $50, the tenant pays $1,050, then the $1,050 is the rent, and it’s subject to that five percent,” he said.
Perello said if there is a Consumer Price Index (CPI) and it’s included, and it’s two percent, and the landlord can raise the rent by five percent, is the rent going up by seven percent.
